This site has been started so as to enable the dissemination of relevant information regarding the proposed development of the old milk-bar site on the corner of Sunrise Drive and Simon Crescent into a Brethren Worship Hall.

Update from Belinda Clarkson on the applicability of rates. Below are extracts from various emails as well as the reference to the Section 154 of the Local Government Act mentioned. Hi Belinda The current rate status of the properties are: · The school at Ironbark and Pioneer Roads is non-rateable. · The residence at Ironbark and Pioneer Roads is currently rated. We have been advised that they now use this as part of the school. The status will be changed to non-rateable as part of the supplementary valuation in December. · The properties on Diamond Creek Road are rateable. When construction has been completed and Council has been advised that these sites have had a change of use to charitable purposes, the properties on Diamond Creek Road will assessed as non-rateable Dear Belinda Further to your email, advice from officers follows: Further to your enquiry at the recent Blue Lake Ward meeting for Cr Clarkson, I am writing to confirm that under Section 154 (2)(c) of the Local Government Act 1989 (the Act), land used as a place of worship is not rateable as it is deemed to be held for charitable purposes under the Act. Land at 60-62 Sunrise Drive, Greensborough is currently rateable as it is deemed to be used for "mixed use". To be deemed non rateable under the Act, the owner/occupier is required to apply for a change in use which demonstrates that the land is now used for charitable purposes. Council records currently indicate that there are five premises used as a place of worship by the Brethren which are deemed non rateable. The Diamond Creek Road and Sunrise Drive premises are currently deemed rateable. |

| 18-10-2011 | I along with Sal, Leigh and Denis attended the Blue Lake Ward meeting 17/10/2011 and I thought I'd keep you informed of what was discussed relative to the worship hall(s). Firstly, I want to thank Belinda Clarkson for the meeting and the opportunity for we the residents to put our questions forward with the hope of having them answered. The meeting started at 7pm at the Yarrambat Golf Club rooms and was well attended by many Nillumbik residents. Unfortunately, I would have liked more of our local community there in order to field questions to Belinda and other council members. Many issues were raised, but I will only cover the questions we put to Belinda and others. Q: Do the Brethren Worship halls pay rates? A: The council CEO was quite confident they did not, but Belinda to check and get back to me with a definite answer. Q: When will the issue be raised at a planning meeting? A: The tentative date is the Tuesday 8th November. But we should get notification prior to this meeting. Q: Will we get an opportunity at this meeting to discuss with council our issues? A: No. This meeting is to allow us to put our objections forward. Each person attending the meeting will be given a maximum of 3 minutes to put their objections forward. There is no limit on how many people can attend and put objections forward. I URGE ALL WHO HAVE PUT WRITTEN OBJECTIONS FORWARD TO ATTEND THE MEETING. The committee will be formulating a presentation but don't rely on this alone. Show you care by preparing your own or joining us at the next committee meeting. Follow up question to Belinda. If we wish to address the council in a round table discussion. how can this be arranged? Issues I think we need to follow up before the council meeting. 1. A Title search for both the Sunrise Drive and Beales Road milk bar sites. Is this something council can help us with Belinda? 2. So far we have had responses from Harry Jenkins MP and Danielle Green MP. Hon. Matthew Guy (Planning minister) and Jenny Macklin MP are still to give any response. I will follow up with their offices. - Contacted Ms. Macklin's office and spoke to Lochlan. I have booked a tentative meeting for the 10th November (earliest available time - to be confirmed by her office) - Contacted Mr. Guy's office and spoke to Susan Turner. Susan will forward our concerns to Mr. Guy. |

I've forwarded this email to all members of the email group and have requested people to respond if they would like to attend. This way we can put forward a unified face. Dear Ms Clarkson I have been informed by a fellow resident of the Sunrise Estate that there is a meeting next Tuesday 6th September at the Aston Manor (Refer Below). I am interested in attending the meeting to voice our concern regarding the proposed redevelopment of the milk bar site. I have a few questions: 1. What time is the meeting? 6.45pm |
